1. Acceptance of Terms

By accessing and using SeaMark Certificates ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Service Description

SeaMark Certificates provides a web-based platform for charter operators and maritime professionals to generate, store, and deliver professional Certificates of Spreading of Ashes at Sea. The Service includes:

  • Digital certificate generation with GPS coordinates
  • Secure certificate storage for 365 days
  • Email delivery to designated recipients
  • Signature management and customization
  • Multi-user access (up to 5 users per account)

3. Free Trial

New users receive a 30-day free trial period or 4 certificate generations, whichever comes first. During the trial:

  • Full access to all Service features
  • No credit card required to start
  • Trial ends automatically after 30 days or 4 certificates
  • Email verification is required before certificate generation

4. Subscription and Billing

After the trial period, continued use requires a paid subscription:

  • Monthly Subscription: $3.99 per month
  • Per Certificate Fee: $2.00 per certificate generated
  • Billing is automatic and recurring
  • All fees are in USD
  • Prices subject to change with 30 days notice

5. Refund Policy

We offer a 30-day money-back guarantee:

  • Full refund available within 30 days of first payment
  • Includes monthly subscription fee and certificate fees
  • Request refunds by contacting support@seamarkcertificates.com
  • Refunds processed within 5-10 business days
  • After 30 days, all payments are final

6. User Accounts and Security

You are responsible for:

  • Maintaining confidentiality of account credentials
  • All activities conducted under your account
  • Notifying us immediately of unauthorized access
  • Ensuring information provided is accurate and current
  • Compliance with all applicable laws and regulations

7. Data Storage and Retention

Certificate data is stored as follows:

  • Generated certificates stored for 365 days
  • Automatic deletion after 365 days
  • Download certificates within retention period
  • User data retained per our Privacy Policy
  • Backups maintained for service reliability

8. Acceptable Use

You agree NOT to:

  • Use the Service for illegal purposes
  • Generate fraudulent or misleading certificates
  • Attempt to access unauthorized areas of the Service
  • Interfere with Service operations or security
  • Resell or redistribute Service access
  • Use automated tools to access the Service

9. Intellectual Property

All Service content, features, and functionality are owned by SeaMark Certificates and protected by copyright, trademark, and other intellectual property laws. You retain ownership of your certificate data and signatures.

10. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service unavailability.

11. Limitation of Liability

To the maximum extent permitted by law, SeaMark Certificates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount paid by you in the 12 months preceding any claim.

12. Termination

You may cancel your account at any time through the account settings. We may suspend or terminate accounts that violate these terms. Upon termination, you retain access to certificates until the 365-day retention period expires.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the Service after changes constitutes acceptance of modified terms. Material changes will be communicated via email.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of [Your State/Jurisdiction].
